1. Acceptance of these terms

This website is operated by Foren Ecommerce (“we”, “us”, “our”) under the brand Foren Shop. By browsing this website, creating an account or placing an order, you (“you”, “the customer”) accept these Terms & Conditions.

Our Privacy Policy, Shipping & Delivery Policy and Cancellation, Return & Refund Policy are incorporated into these terms by reference and apply to every order.

If you do not agree with any part of these terms, please do not use this website.

2. Who may use this website

You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872.
If you are under 18, you may use the site only under the supervision of a parent or legal guardian, who accepts these terms on your behalf and is responsible for your orders.
You must provide accurate and complete information when creating an account or placing an order.
The site is intended for personal, non-commercial shopping. Buying for resale, or in quantities that indicate resale, is not permitted without our written agreement.

3. Your account

Some parts of the site — your basket, wishlist, saved addresses, orders and checkout — require an account. Access is verified by a one-time password sent to your registered mobile number.

In using an account, you agree that:

You are responsible for everything done through your account, and for keeping your registered mobile number and device secure.
You will not share a one-time password with anyone. We will never ask you for one.
You will keep your contact details and addresses accurate, since deliveries and order updates depend on them.
You will tell us at support@forenshop.in as soon as you suspect unauthorised use of your account.
You will not create an account in someone else's name, or hold more than one account to abuse offers, coupons or return windows.

We may suspend or close an account where we have reasonable grounds to believe it is being used fraudulently, to abuse promotions or returns, or in breach of these terms. Where we do so, any order already paid for is either fulfilled or refunded.

4. Products, listings and availability

Listings are an invitation to place an order, not an offer. A contract of sale is formed only when we confirm your order, as described below.
We take care with descriptions, images and specifications, but they are prepared partly from information supplied by brands and manufacturers and may contain errors or become outdated.
Product colours may appear differently on different screens, and manufacturers may change packaging without notice.
Availability is not guaranteed until an order is confirmed. Stock is held by warehouse, and an item can sell out between the moment it enters your basket and the moment you pay.
We may add, change, limit the quantity of, or withdraw any product at any time.

5. Placing an order

An order is formed in these steps:

You add items to your basket, choose a delivery address and a payment method, and we display the total payable including delivery charges and applicable taxes.
You place the order. This is your offer to buy at the prices shown.
We send an acknowledgement that we have received the order. An acknowledgement is not yet acceptance.
We accept the order — and the contract is formed — when we confirm it after successful payment, or after verification for a cash-on-delivery order. You may also be sent a separate notification when it is dispatched.

We may decline or cancel an order, before or after confirmation, where:

The item is out of stock or has been withdrawn.
There has been an obvious pricing or description error.
The delivery address falls outside the area our courier partners serve.
Payment has failed, been reversed or is suspected to be unauthorised.
We reasonably suspect fraud, abuse of an offer, or a breach of these terms.
Delivery is prevented by something outside our reasonable control.

Where we cancel a confirmed order for any of these reasons, you are refunded in full for that order, including any delivery charge collected on it, in the manner set out in our Cancellation, Return & Refund Policy.

6. Pricing

All prices are in Indian Rupees (₹) and, unless a listing says otherwise, are inclusive of applicable Goods and Services Tax.
Delivery charges, where payable, are shown separately at checkout before you confirm the order.
Any “was” or struck-through price shown alongside a selling price is the maximum retail price or our own earlier price for the same item, and the discount shown is calculated against it.
Prices can change at any time, including between the time you add an item to your basket and the time you check out. The price that applies to your order is the one displayed on the order review screen when you place it.
We do not price-match, and a later price reduction does not entitle you to a refund of the difference on an order already placed.

Obvious pricing errorsOccasionally an item may be listed at a clearly incorrect price. Where the error is obvious and could reasonably have been recognised as such, we are not obliged to supply at that price. We will contact you, and you may either confirm the order at the correct price or cancel it for a full refund.

7. Payments

Payment is taken through a secure third-party payment processor. Your card, UPI or net-banking credentials are entered with that processor and are never stored by us.
The payment options available to you are shown at checkout and may vary by order value, item and delivery location.
Where cash on delivery is offered, a handling charge of ₹49 may apply and will be shown before you confirm.
An order is processed only once payment is confirmed as successful. If an amount is debited but the order is not confirmed, it is normally reversed by your bank automatically; if it is not, write to us with the transaction reference and we will trace it.
You confirm that any payment instrument you use belongs to you, or that you have the account holder's permission to use it.

8. Taxes and invoicing

Goods and Services Tax is charged at the rates applicable to each product under Indian law, and the applicable rate is reflected in the price you pay.
A tax invoice is issued for every order and is available from the order in your account.
If you need an invoice raised against a business GSTIN, that GSTIN must be supplied at the time of ordering. We cannot add or change a GSTIN on an invoice after an order has been dispatched.
Where tax rates or rules change between the date an order is placed and the date it is invoiced, the rate in force on the date of supply applies.

9. Shipping and delivery

Delivery is governed by our Shipping & Delivery Policy, which forms part of these terms. In summary: delivery timelines are estimates and not guarantees; risk in the goods passes to you on delivery; and someone at the address must be available to receive the shipment.

10. Cancellations, returns and refunds

Cancellations, returns, replacements and refunds are governed by our Cancellation, Return & Refund Policy, which forms part of these terms. In summary: an order can be cancelled free of charge before dispatch; most items can be returned within 7 days of delivery if they are unused and in their original condition; and damaged, defective or incorrect items must be reported within 48 hours of delivery.

11. Your responsibilities

When using this website, you agree not to:

Provide false, misleading or someone else's personal or payment details.
Use the site for any unlawful purpose, or in a way that breaches Indian law.
Attempt to gain unauthorised access to the site, its servers, or another customer's account.
Introduce a virus, harmful code or anything designed to interfere with the site's operation.
Scrape, harvest, copy or systematically extract content, prices or listings from the site by automated means.
Post a review, rating, photograph or comment that is false, defamatory, obscene, infringing, or not based on genuine experience of the product.
Repeatedly refuse delivery, or place orders with no intention of accepting them.
Misuse coupons, offers or the return window, including by creating multiple accounts.

Content you post — a review, a rating, a photograph — remains yours, but you grant us a non-exclusive, royalty-free licence to display, reproduce and adapt it on the site and in connection with the product it relates to. We may remove content that breaches these terms.

You are also responsible for keeping the goods you receive in a saleable condition until any return window closes, and for the accuracy of the address and phone number you give us for delivery.

12. Intellectual property

The design, layout, text, graphics, photographs, logos, icons, software and arrangement of this website are owned by us or licensed to us, and are protected by Indian copyright, trade mark and other intellectual property law.

You may view, download and print pages of this site for your own personal, non-commercial use.
You may not reproduce, republish, distribute, sell, frame or create derivative works from any part of the site without our written permission.
Brand names, trade marks and product images belonging to manufacturers and brands remain the property of their respective owners and are used on this site to identify the products we sell.
Nothing on this site grants you any licence or right in any trade mark or copyright shown on it.

If you believe content on this site infringes your intellectual property rights, write to support@forenshop.in with details of the work, the listing concerned and the basis of your claim, and we will investigate.

13. Third-party links and services

The site may link to websites and services operated by others — brands, manufacturers, couriers and payment processors. We do not control them and are not responsible for their content, their policies or their availability. Your use of those services is governed by their own terms.

14. Limitation of liability

The site and its content are provided on an “as is” and “as available” basis. We do not warrant that the site will be uninterrupted, error-free or free of harmful components, though we take reasonable care to keep it so.

To the maximum extent permitted by law:

Our total liability arising out of or in connection with any order is limited to the amount you actually paid for that order.
We are not liable for indirect, incidental, special or consequential loss, or for loss of profit, business, goodwill, data or anticipated savings.
We are not liable for delay or failure caused by events outside our reasonable control, including natural events, strikes, civil disruption, network or power failure, transport disruption, epidemics, and acts of government or regulatory authority.
We are not liable for defects in manufacture, which are the responsibility of the manufacturer under the applicable product warranty, though we will help you pursue a warranty claim.

Nothing here removes your statutory rightsNothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under the Consumer Protection Act, 2019. Your rights as a consumer under Indian law stand in addition to these terms.

15. Indemnity

You agree to indemnify us against any claim, loss, liability or reasonable expense arising from your breach of these terms, your misuse of the site, your infringement of anyone else's rights, or your violation of any applicable law.

16. Changes to these terms

We may revise these terms from time to time to reflect changes in our services, our operations or the law. The version published on this page is the version in force, and the “last updated” date above records when it last changed. The terms that govern an order are those in force when the order was placed. Continuing to use the site after a change takes effect means you accept the revised terms.

17. Governing law and disputes

These terms, and any contract formed under them, are governed by the laws of India.

If something goes wrong, we would rather fix it than argue about it. Please follow this order:

Raise the issue with our support team at support@forenshop.in or +91 98765 43210. Most matters are settled here.
If you are not satisfied, escalate it to our Grievance Officer, whose details are on our Contact Us page. Grievances are acknowledged within 48 hours and addressed within 30 days.
If it remains unresolved, you are free to pursue any remedy available to you under law.

Subject to your rights as a consumer, the courts at Mumbai, Maharashtra have jurisdiction over disputes arising out of these terms. This does not affect your right to approach a District, State or National Consumer Disputes Redressal Commission at the place permitted by the Consumer Protection Act, 2019.

18. General

If any provision of these terms is held to be invalid or unenforceable, the rest continues in force.
A failure by us to enforce a provision is not a waiver of our right to enforce it later.
These terms, together with the policies incorporated into them, are the whole agreement between us in relation to your use of this website.
You may not assign your rights under these terms without our consent; we may assign ours as part of a transfer of the business.
